Every once in a while you come across a story that just makes you sit back and think if everyone is a hot head these days because of facebook and twitter.
A lady who was pulled over and given a speeding ticket in Michigan decided to let the officer know as she was pulling away what she thought of it. According to the A.P.…
A federal appeals court says a Michigan woman’s constitutional rights were violated when she was handed a speeding ticket after giving the finger to a suburban Detroit officer in 2017. The decision means a lawsuit by Debra Cruise-Gulyas can proceed.
In a 3-0 decision Wednesday, the court said Taylor Officer Matthew Minard “should have known better,” even if the driver was rude.
Minard stopped Cruise-Gulyas and wrote her a ticket for a lesser violation. But when that stop was over, Cruise-Gulyas raised her middle finger.
The officer did not find that amusing and pulled her over again and gave her a tacker for a more serious speeding citation. The woman ticketed found that even more infuriating and sued to say her free speech rights were violated.
The lady in question should not have flipped the cop off and he should not have pulled her back over letting her get under his skin.
The First Amendment to the United States Constitution says this…
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
The Police Officer is part of the local government and she did petition that representative with her grievance, albeit in a not so classy way. She could have waited until the officer had left and let loose but she chose this method.
She won.
Freedom of expression is important. So is keeping your cool with authorities. Hopefully, that is the lesson picked up here.
